Larceny is the illegal taking and carrying away of personal property belonging to another with the purpose of depriving the owner of its possession.

Oklahoma Grand Larceny and Petit Larceny

Oklahoma has two degrees of larceny, the first is grand larceny and the second is petit larceny. Grand Larceny consists of the taking of personal property worth $500 or more. Petit Larceny is the taking of personal property of less than $500.

Forms of Larceny in Oklahoma

Oklahoma Legislature has also defined several different forms of the crime of larceny that deal with different types of property that have been wrongfully taken.

  • Unlawful Consumption of Gas: It is illegal to break into a gas pipeline for the purpose of generating power to a structure and bypassing the meter.
  • Larceny of Livestock: The crime of wrongfully taking of any livestock or animals associated with the running and production of a farm.
  • Larceny of Fixtures: Any fixture or part of realty that is removed from the realty becomes personal property.
  • Motorized Equipment: The taking of automobiles, tractors, airplanes or any other motor vehicle from someone’s property.
  • Trade Secrets: Trade secrets are personal property that is highly protected in order to promote free trade and competition between businesses.
  • Copper: Removing copper from construction sites to resale for money.
  • Larceny of Structure: Taking property from any permanent or temporary structure
  • Retail Larceny: This consist of taking any merchandise or property from a retail store.

Punishment for Larceny in Oklahoma

  • Petit Larceny: Punishment for petit larceny in Oklahoma ranges up to six (6) months in jail and $500 in fines.
  • Grand larceny: Punishment for grand larceny in Oklahoma ranges from one (1) to five (5) years in prison and the defendant could be forced to make restitution.
  • Grand Larceny in a Delling: Punishment for grand larceny in a dwelling in Oklahoma ranges up to eight (8) years in prison and the defendant could be forced to make restitution.
  • Larceny in the Nighttime: Punishment for larceny in the nighttime in Oklahoma is up to ten (10) years in prison and the defendant could be forced to make restitution.
